Last Updated: September 11, 2026

These Terms of Service govern your access to and use of the xsdfr online store and your purchase of products from us.

The xsdfr online store is operated by コスモス商事株式会社 and currently serves customers in Germany and Austria.

Throughout these Terms, the terms “we,” “us,” “our,” and “xsdfr” refer to コスモス商事株式会社, where appropriate.

By visiting our website, using our Services or placing an order, you agree to these Terms together with our:

  • Privacy Policy;
  • Return and Refund Policy;
  • Shipping and Delivery Policy;
  • Payment Policy; and
  • Other policies clearly displayed on our website.

Please read these Terms carefully before using our Services.

Nothing in these Terms is intended to exclude, restrict or reduce any mandatory consumer rights available to customers in Germany or Austria under applicable European Union or national consumer protection law.

2. Eligibility to Use the Services

You may use the Services only if you are legally capable of entering into a binding agreement under applicable law.

Where required by applicable law, minors may use the Services only with the involvement or authorization of a parent or legal guardian.

You agree to use the Services only for lawful purposes and in accordance with these Terms.

We may restrict or suspend access where we reasonably believe that a user:

  • Has materially violated these Terms;
  • Has supplied false or misleading information;
  • Is engaging in fraudulent or unlawful activity;
  • Has attempted unauthorized access;
  • Has interfered with website security; or
  • Creates a material security or legal risk.

3. Customer Accounts

Certain Services may allow you to create a customer account.

You are responsible for ensuring that information supplied through your account is accurate and up to date.

This may include:

  • Your name;
  • Email address;
  • Telephone number;
  • Billing address;
  • Delivery address; and
  • Other information reasonably necessary to process an order.

You are responsible for protecting your account credentials.

Please contact us promptly if you believe that your account has been accessed without authorization.

You must not sell, transfer or provide unauthorized access to your customer account.

4. Product Information

We take reasonable steps to ensure that product descriptions, specifications, prices, availability information and images displayed on our website are accurate.

The appearance of a physical product may differ slightly from images displayed online due to:

  • Screen settings;
  • Lighting;
  • Photography;
  • Manufacturing variations;
  • Device settings; or
  • Minor product updates.

Any difference will not affect your statutory rights where a product is materially different from its description, defective or otherwise non-conforming.

We may correct or update product information where reasonably necessary.

5. Product Availability

All products are subject to availability.

Adding a product to your shopping cart does not necessarily reserve that product.

If a product becomes unavailable after you place an order, we may:

  • Contact you;
  • Cancel the affected product;
  • Offer an appropriate alternative with your consent; or
  • Refund any amount already paid for the unavailable product.

We will not substitute a materially different product without your agreement.

6. Placing an Order

Submitting an order through our online store constitutes an offer to purchase the selected products.

An automated order acknowledgment confirms that we have received your order but does not necessarily mean that your order has been finally accepted.

A purchase contract will normally be formed when we:

  • Confirm acceptance of your order;
  • Confirm that the order has been dispatched; or
  • Otherwise expressly confirm acceptance.

Before submitting an order, please review your:

  • Products;
  • Quantity;
  • Price;
  • Delivery address;
  • Contact details; and
  • Payment information.

You are responsible for ensuring that the information submitted with your order is accurate.

7. Order Rejection or Cancellation

We may reject or cancel an order where reasonably necessary, including where:

  • A product is unavailable;
  • Payment cannot be authorized or verified;
  • Billing or delivery information is materially incorrect;
  • Fraudulent or unauthorized activity is reasonably suspected;
  • There is an obvious pricing or product-information error;
  • Delivery to the destination is unavailable;
  • Applicable purchase restrictions are exceeded; or
  • Processing the transaction would violate applicable law.

If we cancel an order after payment has already been collected, the relevant amount will be refunded in accordance with applicable law and our Payment and Refund Policies.

Nothing in this section reduces your mandatory consumer rights.

8. Prices

The price applicable to your purchase will normally be the price displayed on the product page and during checkout when you submit the order.

Before completing your purchase, the checkout page will display the amount payable by you.

Prices, promotions and discounts may change before an order is submitted.

Once an order has been accepted, a later price change will not normally affect that order.

Promotions may be subject to additional conditions such as:

  • Promotional periods;
  • Product restrictions;
  • Eligibility requirements;
  • Minimum purchase values; or
  • Usage limits.

9. Taxes, VAT, Duties and Charges

For orders delivered to Germany and Austria, the price and any charges collected by us will be displayed during checkout.

Where applicable, prices presented to consumers will include taxes required to be included under applicable law.

Any shipping charges or other charges collected by us will be disclosed before the order is completed.

Where an order is shipped internationally, customs procedures or import requirements may apply.

We will not intentionally present an unavoidable charge as optional or conceal a mandatory charge from the customer.

Any specific pricing, tax, shipping or payment information displayed during checkout for your order takes priority over general information in this section.

10. Payment

The payment methods available for your order are the methods actually displayed during checkout.

Payment options may depend on factors such as:

  • Delivery country;
  • Currency;
  • Order value;
  • Product type; and
  • Payment-provider availability.

By submitting payment information, you confirm that you are authorized to use the selected payment method.

Payments may be processed through Shopify or independent authorized payment service providers.

Where Cash on Delivery (COD) is available, its availability will be clearly shown during checkout.

If COD is not displayed during checkout, it is not available for that order.

We may delay or cancel an order where payment cannot reasonably be verified or authorized.

11. Order Confirmation

After placing an order, you will normally receive an order confirmation using the contact information provided during checkout.

Please review the confirmation carefully.

If you identify an error, please contact us as soon as reasonably possible:

Email: support@xsdfr.shop

12. Shipping and Delivery

We currently deliver to customers in:

  • Germany
  • Austria

Shipping conditions, delivery estimates and any applicable delivery charges are governed by our Shipping and Delivery Policy and the information displayed during checkout.

Delivery times displayed on our website are estimates unless expressly stated to be guaranteed.

Delivery may be affected by circumstances such as:

  • Carrier delays;
  • Customs procedures;
  • Incorrect delivery information;
  • Severe weather;
  • Public holidays;
  • Transport disruptions;
  • Regulatory restrictions; or
  • Other events genuinely outside our reasonable control.

You are responsible for providing an accurate and complete delivery address.

For consumer orders, the risk of loss or damage will generally pass to the consumer when the consumer, or a third party designated by the consumer other than the carrier, physically receives the goods, subject to applicable law.

13. 14-Day Right of Withdrawal

Consumers in Germany and Austria purchasing eligible products online generally have a statutory 14-day right of withdrawal.

The withdrawal period generally begins when you, or a third party designated by you other than the carrier, receive the goods.

Where the statutory right applies, consumers may generally:

  • Withdraw from the purchase without giving a reason;
  • Notify us within the applicable statutory period;
  • Return eligible goods within the applicable return period; and
  • Receive the reimbursement required by applicable consumer law.

Our voluntary return policy does not replace, reduce or restrict the statutory 14-day withdrawal right.

For full information regarding withdrawal procedures, exclusions, return costs and refunds, please refer to our Return and Refund Policy.

14. Voluntary Returns

In addition to statutory rights, we may provide a voluntary return period as described in our Return and Refund Policy.

Any voluntary return policy is provided in addition to statutory consumer rights and does not replace them.

Eligibility, product condition requirements, return instructions and refund procedures are governed by the Return and Refund Policy displayed on our website.

15. Refunds

Approved refunds will generally be made using the same payment method used for the original transaction unless:

  • Another method is agreed with you;
  • The original method cannot reasonably receive the refund; or
  • Applicable law requires another method.

Where the statutory right of withdrawal applies, refunds will be handled within the period required by applicable law.

For physical goods, where legally permitted, we may withhold reimbursement until:

  • We receive the returned goods; or
  • You provide satisfactory evidence that the goods have been sent back,

whichever occurs first.

Where a customer paid by Cash on Delivery, there may be no electronic transaction available to reverse.

In such cases, an approved refund may be arranged by bank transfer or another appropriate method agreed with the customer.

16. Defective, Damaged or Non-Conforming Products

Nothing in these Terms restricts mandatory consumer rights concerning products that are:

  • Defective;
  • Damaged;
  • Incorrectly supplied;
  • Missing essential components;
  • Not as described; or
  • Otherwise non-conforming.

Depending on applicable law and the circumstances, remedies may include:

  • Repair;
  • Replacement;
  • Price reduction;
  • Refund; or
  • Another statutory remedy.

Mandatory legal guarantee rights available to consumers in Germany and Austria remain unaffected.

17. Order Cancellation Before Shipment

If you wish to cancel an order before shipment, please contact us as soon as possible.

We will attempt to cancel the order if it has not already entered final processing or shipment.

If the order has already been shipped, cancellation may need to be handled through the applicable statutory withdrawal or return procedure.

Your mandatory consumer rights remain unaffected.

18. Intellectual Property

Content available through our Services may be protected by copyright, trademark and other intellectual property laws.

Such content may include:

  • Brand names;
  • Logos;
  • Product names;
  • Product descriptions;
  • Photographs;
  • Graphics;
  • Videos;
  • Text;
  • Website design;
  • Software;
  • Layouts; and
  • Other materials.

Content may belong to コスモス商事株式会社, Shopify, licensors or other rights holders.

Unless permitted by law or expressly authorized, you must not:

  • Copy protected content;
  • Republish it;
  • Sell or commercially exploit it;
  • Modify or create unauthorized derivative works;
  • Remove intellectual property notices; or
  • Use our brand or trademarks in a misleading manner.

Nothing in these Terms transfers ownership of our intellectual property to you.

19. Reviews and User-Submitted Content

Where our Services allow you to submit reviews, photographs, videos, comments or other content, you remain responsible for the content you submit.

You confirm that submitted content:

  • Is lawful;
  • Is not knowingly false or misleading;
  • Does not infringe another person's rights;
  • Does not contain malicious software;
  • Is not defamatory, threatening or abusive; and
  • Is submitted with the necessary rights or permissions.

You retain ownership of your original content.

Where reasonably necessary to operate or promote our Services, you grant us a non-exclusive license to display, reproduce and use submitted content for legitimate purposes relating to our store.

We may remove unlawful or inappropriate content where reasonably necessary.

20. Third-Party Tools and Services

Our Services may contain features supplied by third parties.

These may include:

  • Payment processors;
  • Shipping services;
  • Analytics providers;
  • Customer-support systems;
  • Marketing platforms; or
  • Other applications integrated with Shopify.

Your use of an independent third-party service may also be subject to that provider's own terms and privacy policy.

21. Shopify

Our online store is powered by Shopify.

Shopify provides technical services that may include:

  • Store hosting;
  • Checkout technology;
  • Store-management functions;
  • Payment integrations;
  • Security tools; and
  • Technical infrastructure.

Products displayed on xsdfr.shop are sold by コスモス商事株式会社, unless clearly stated otherwise.

Shopify provides the e-commerce platform and is not the seller of our products.

22. Privacy

Personal information is handled according to our Privacy Policy.

Our Privacy Policy explains matters including:

  • What information we collect;
  • Why we use it;
  • Who it may be shared with;
  • International data transfers;
  • Data retention;
  • Cookies; and
  • Applicable privacy rights.

23. Errors and Corrections

Our website may occasionally contain:

  • Typographical errors;
  • Incorrect prices;
  • Outdated information;
  • Availability errors;
  • Incorrect delivery estimates; or
  • Other inaccuracies.

We may correct genuine errors once identified.

If an obvious error materially affects an order already submitted, we may contact you and provide an appropriate solution, such as:

  • Proceeding with corrected information with your agreement; or
  • Cancelling the affected order and issuing the appropriate refund.

We will not use this section to remove or reduce mandatory consumer rights.

24. Prohibited Uses

You must not use the Services:

  • For unlawful or fraudulent activity;
  • To violate applicable laws;
  • To infringe intellectual property rights;
  • To infringe privacy rights;
  • To deliberately provide false information;
  • To impersonate another person;
  • To distribute malicious software;
  • To gain unauthorized access;
  • To interfere with website security;
  • To bypass security controls;
  • To unlawfully collect personal information; or
  • To commercially exploit protected website content without permission.

We may restrict access where reasonably necessary to protect the Services, customers or third parties.

25. Availability of the Services

We take reasonable steps to maintain the availability and security of our website.

However, we cannot guarantee that the Services will always be:

  • Uninterrupted;
  • Completely free of errors;
  • Compatible with every device;
  • Free from temporary technical issues; or
  • Available during maintenance or third-party outages.

Nothing in this section excludes mandatory statutory rights.

26. Limitation of Liability

To the maximum extent permitted by applicable law, we are not responsible for indirect or consequential losses that were not reasonably foreseeable when the relevant contract was formed.

Nothing in these Terms excludes or limits liability where liability cannot legally be excluded or limited.

This includes, where applicable, liability relating to:

  • Fraud;
  • Fraudulent misrepresentation;
  • Intentional misconduct;
  • Death or personal injury caused by negligence;
  • Mandatory product liability;
  • Gross negligence where liability cannot legally be limited; or
  • Mandatory consumer rights.

For consumers in Germany and Austria, any limitation of liability in these Terms applies only to the extent permitted by applicable mandatory law.

27. Force Majeure

We will not be responsible for failure or delay caused by circumstances genuinely outside our reasonable control.

Such circumstances may include:

  • Natural disasters;
  • Extreme weather;
  • War;
  • Civil unrest;
  • Government action;
  • Epidemics;
  • Strikes;
  • Major transportation disruption;
  • Telecommunications failures;
  • Power outages;
  • Customs restrictions; or
  • Failure of critical third-party infrastructure.

Where such an event affects an order, we will take reasonable steps to minimize the impact and communicate with affected customers.

Nothing in this section removes any mandatory right to a refund, cancellation or other remedy where such a right applies under applicable law.

28. Suspension and Termination

We may suspend or terminate access to some or all Services where reasonably necessary because:

  • These Terms have been materially breached;
  • Fraud or unlawful activity is reasonably suspected;
  • Website security has been threatened;
  • An account presents a material risk to another person; or
  • We are legally required to do so.

Termination does not affect rights or obligations that arose before termination.

29. Severability

If any provision of these Terms is held to be unlawful, invalid or unenforceable, that provision will apply to the fullest extent legally permitted.

The remaining provisions will continue in effect.

30. No Waiver

If we do not immediately enforce a right under these Terms, this does not mean that we permanently waive that right.

31. Entire Agreement

These Terms, together with policies incorporated by reference and information presented to you during checkout, form part of the agreement governing your use of the Services and purchases through our online store.

Nothing in this section excludes information or disclosures that must legally form part of a consumer contract.

32. Assignment

You may not transfer your customer account or contractual obligations to another person without authorization, except where applicable law permits otherwise.

We may transfer our rights and obligations as part of a legitimate:

  • Corporate restructuring;
  • Merger;
  • Acquisition;
  • Sale of business; or
  • Transfer of business assets.

Any such transfer will not reduce mandatory consumer rights.

33. Governing Law

These Terms and the operation of the xsdfr online store are generally governed by the applicable laws of Japan.

However, for consumers located in Germany or Austria, this choice of law does not deprive you of mandatory consumer protections available under the laws of your country of habitual residence or under applicable European Union law.

Nothing in these Terms requires a consumer to waive a right that cannot legally be waived.

34. Disputes and Complaints

If you have a complaint or dispute, please contact us first so that we can attempt to resolve the matter directly.

Email: support@xsdfr.shop
Telephone: +81 90 5156 1861

If a dispute cannot be resolved directly, consumers may use any dispute-resolution mechanism or court procedure available under applicable law.

Nothing in these Terms prevents a consumer in Germany or Austria from bringing a claim before a competent court where that right exists under applicable law.

35. Changes to These Terms

We may update these Terms from time to time to reflect:

  • Changes to our Services;
  • Changes to business operations;
  • Technical developments;
  • Security requirements;
  • Changes in applicable law; or
  • Other legitimate operational reasons.

The latest version will be published on our website with an updated revision date.

Changes will not retroactively remove mandatory rights connected with an existing purchase unless permitted by applicable law.
